1. Overview and Acceptance of These Terms
This website is operated by SAUNABOX LLC (referred to in these Terms as “SaunaBox,” “we,” “us,” or “our”). SaunaBox offers this website and the information, tools, products, and services available through it (collectively, the “Services”) to you, conditioned on your acceptance of these Terms of Service (these “Terms”), together with the policies and notices referenced or linked herein.
By accessing or using the website, placing an order, purchasing a Product, or using a Product, you agree to be bound by these Terms. If you do not agree to all of these Terms, you may not access the website, use the Services, purchase a Product, or use a Product.
These Terms apply to all website users, including browsers, customers, vendors, merchants, and contributors of content. Any new features, tools, products, or services added to the website will also be subject to these Terms.
Important safety notice: SaunaBox Products involve exposure to heat, cold, electricity, and other inherent risks. Read the complete product manual and all safety instructions before installation or use. Failure to follow instructions may cause serious injury, illness, death, or property damage and may void applicable warranty coverage.
2. Definitions
For purposes of these Terms:

|
A Participant who is 18 years of age or older, or, if the Participant is under 18, the Participant and the Participant’s parent or legal guardian.

3. Product Safety, Medical Disclaimer, and Assumption of Risk
3.1 Medical Disclaimer
Products are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Statements on the website, in product manuals, in marketing materials, or otherwise relating to Products have not been evaluated as medical advice.
Before using a sauna, cold plunge, red-light therapy device, or other Product, you should consult a licensed physician or other qualified healthcare professional, particularly if you are pregnant, nursing, elderly, under medical supervision, or have a medical condition or health concern, including heart disease, high or low blood pressure, circulatory or respiratory conditions, impaired sensation, or heat- or cold-related sensitivity.
To the fullest extent permitted by applicable law, SaunaBox disclaims liability for injuries, health complications, illness, or death arising from improper, unsafe, or unsupervised use of a Product.
3.2 Product Manual Requirement
You must read the complete product manual, all warnings, and all safety instructions before installing or using any Product. You are responsible for ensuring that every person who uses a Product has been informed of and follows the applicable manual and safety instructions.
Failure to follow the product manual, safety instructions, or these Terms constitutes misuse. Misuse may void warranty coverage and may limit SaunaBox’s responsibility to the maximum extent permitted by applicable law.
3.3 Inherent Risks
The Undersigned acknowledges that the Activity involves inherent and other risks, whether known or unknown, including burns, dehydration, dizziness, fainting, slips, falls, electrical shock, heat exposure, cold exposure, physical or mental distress, illness, property damage, and death. These risks may arise from a Product, the environment in which it is used, the actions or omissions of the Participant or another person, installation conditions, or other causes.
By purchasing, owning, installing, or using a Product, the Undersigned voluntarily assumes all risks associated with the Activity, to the fullest extent permitted by law.
3.4 Required Safe-Use Conditions
You must use Products only in accordance with the applicable product manual and the following minimum requirements:

|
Do not install or use a Product outdoors, expose it to water, modify it, alter it, or use unauthorized parts except where the product manual expressly permits it.

Minors and vulnerable users
|
Do not permit unsupervised use by minors or by individuals who cannot understand and follow safety instructions. Children under 18 must be supervised by a responsible adult at all times.

Improper installation, outdoor use, water exposure, modification, alteration, or other misuse may void warranty coverage and any liability protections available to the maximum extent permitted by law.
3.5 Release of Liability
To the fullest extent permitted by applicable law, the Undersigned releases and forever discharges the Released Parties from any and all claims, demands, causes of action, liabilities, damages, costs, or expenses arising from or relating to the Activity or the use of a Product, including claims based on alleged negligence. This release does not apply where a release is prohibited or limited by applicable law.
3.6 Indemnification
To the fullest extent permitted by applicable law, the Undersigned agrees to indemnify, defend, and hold harmless the Released Parties from and against any claims, expenses, damages, medical costs, legal fees, losses, liabilities, or demands arising from the Undersigned’s ownership, installation, use, misuse, or unauthorized distribution of a Product; breach of these Terms; or violation of law or the rights of a third party.
4. Online Store Terms and General Conditions
By agreeing to these Terms, you represent that you are at least the age of majority in your jurisdiction of residence or that you are the age of majority and have given consent for your minor dependents to use the website. You may not use a Product or the Services for an illegal or unauthorized purpose or in violation of applicable law, including intellectual-property laws.
You must not introduce worms, viruses, malware, or other destructive code into the website or Services. A breach of these Terms may result in immediate termination of your access to the Services.
We reserve the right to refuse Service to any person for any lawful reason at any time. Except for payment-card information, which is encrypted during transmission over networks, you understand that content you submit may be transferred unencrypted over various networks and changed as necessary to conform with technical requirements of connecting networks or devices.
You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services or your access to them without our prior written permission. Section headings are for convenience only and do not affect the interpretation of these Terms.
5. Accuracy of Website Information; Modifications; and Prices
Website materials are provided for general information and may not always be accurate, complete, current, or error-free. You should not rely solely on website materials when making decisions. Historical information is provided solely for reference, and we have no obligation to update information except as required by law.
We may modify, suspend, or discontinue any part of the Services, Product descriptions, product availability, or prices at any time without notice. Prices are subject to change without notice. To the fullest extent permitted by law, SaunaBox will not be liable to you or any third party for a modification, price change, suspension, or discontinuance.
We make reasonable efforts to display product colors and images accurately, but we cannot guarantee that a screen’s display of any color will be accurate. Product availability and quantities may be limited. We may limit sales by person, household, order, geographic region, or jurisdiction, and may discontinue a Product at any time. Offers are void where prohibited.
6. Orders, Payments, Billing, and Account Information
All orders must be paid in full at checkout. You are responsible for providing current, complete, and accurate purchase, billing, account, contact, shipping, and payment information and for promptly updating that information as necessary.
You are responsible for all applicable taxes, duties, customs charges, import fees, and similar governmental charges, unless applicable law requires otherwise. We reserve the right to refuse, limit, cancel, or prohibit any order, including orders that appear to be placed by or for dealers, resellers, or distributors or that we reasonably suspect are fraudulent, abusive, or for unauthorized resale or distribution.
If we change or cancel an order, we may attempt to notify you using the email address, billing address, or telephone number provided at the time of purchase. We do not guarantee that we will be able to contact you before an order is changed or cancelled.
7. Shipping, Delivery, Returns, and Cancellations
Portable saunas are ordinarily delivered through UPS, USPS, or another carrier selected by SaunaBox. Wooden saunas are ordinarily delivered curbside only; drivers are not required to move a Product beyond the curbside delivery location.
Carrier delays, loss, or damage may occur after a Product enters the carrier’s custody. To the fullest extent permitted by law, SaunaBox is not responsible for such events. You must inspect deliveries promptly and submit any shipping-damage claim to support@saunabox.com within 14 days after delivery, together with supporting photos and other reasonably requested information.
An order cancelled before shipment may be subject to a processing fee, which may vary by payment method. An order cancelled while in transit or after delivery may be subject to return freight costs and restocking fees, which may be up to $1,250 for large sauna units. Any return or exchange is also subject to the applicable Refund Policy. Where these Terms conflict with a mandatory legal right, that mandatory legal right controls.
8. Limited Warranty Policy
8.1 Residential Use Warranty
For residential use, SaunaBox provides a one-year limited warranty from the date of delivery against manufacturing defects, subject to these Terms and the published warranty information available at [Warranty Page URL]. The warranty remedy is limited to replacement of defective components, as determined by SaunaBox in its reasonable discretion and subject to applicable law.
This limited warranty does not cover normal wear and tear, including fabric wear, stitching wear, or cosmetic blemishes. It also does not cover damage caused by misuse, neglect, improper installation, failure to follow instructions, outdoor use, water exposure, unauthorized modification, alteration, accident, or use of unauthorized parts or accessories.
8.2 Commercial Use Warranty
Products used in a gym, spa, wellness center, or another commercial setting carry a six-month limited warranty. Commercial use must be disclosed to SaunaBox at the time of purchase. Failure to disclose commercial use may void warranty coverage to the maximum extent permitted by law.
8.3 Warranty Claims and Costs
To request warranty service, email support@saunabox.com with proof of purchase, clear photos of the claimed defect, and a description of the issue. SaunaBox may request additional information, troubleshooting steps, or inspection before determining eligibility.
For replacement parts supplied more than 30 days after delivery, the customer is responsible for freight charges. This warranty does not cover labor, installation, removal, transportation, service costs, loss of use, inconvenience, or incidental damages, except where applicable law does not allow those exclusions.
8.4 Warranty Disclaimer and Limitation
Except for the express limited warranty above and any non-waivable warranties required by applicable law, Products are sold “AS IS” and “AS AVAILABLE.” SaunaBox disclaims all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent permitted by applicable law.
9. Optional Tools and Third-Party Links
We may provide access to third-party tools or links that we do not own, monitor, or control. Third-party tools are provided “as is” and “as available,” without warranties, representations, conditions, or endorsement of any kind. Your use of a third-party tool is at your own risk and subject to the terms of the applicable third-party provider.
Third-party links may direct you to websites or resources that are not affiliated with SaunaBox. We are not responsible for their availability, content, accuracy, practices, products, services, or transactions. Review the third party’s policies before engaging in any transaction. Questions or claims concerning third-party products or services should be directed to the applicable third party.
10. User Comments, Feedback, and Submissions
If you submit comments, ideas, suggestions, proposals, plans, contest entries, or other materials to us (collectively, “Comments”), whether requested or unsolicited, you grant SaunaBox a perpetual, worldwide, royalty-free, transferable, sublicensable right to use, reproduce, edit, copy, publish, distribute, translate, and otherwise use those Comments in any medium. We have no obligation to maintain Comments in confidence, compensate you for Comments, or respond to Comments.
We may, but are not required to, monitor, edit, or remove content that we determine in our sole discretion is unlawful, offensive, threatening, libelous, defamatory, obscene, infringing, or otherwise objectionable or that violates these Terms. You are solely responsible for your Comments and their accuracy. You must not submit content that violates another person’s rights, contains unlawful, abusive, or obscene material, includes malware, or misrepresents your identity or the origin of a submission.
11. Privacy and Personal Information
Personal information submitted through the website is governed by our Privacy Policy.
12. Errors, Inaccuracies, and Omissions
The website or Services may occasionally contain typographical errors, inaccuracies, or omissions relating to Product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. We reserve the right to correct any such error, inaccuracy, or omission and to change or update information or cancel orders when information is inaccurate, including after you submit an order, without prior notice where permitted by law.
13. Prohibited Uses
In addition to other restrictions in these Terms, you may not use the website, Services, or content for any unlawful purpose; to solicit unlawful activity; to violate laws or regulations; to infringe intellectual-property or other rights; to harass, abuse, harm, defame, threaten, intimidate, or discriminate against another person; to submit false or misleading information; to upload or transmit malware; to collect or track others’ personal information without authorization; to spam, phish, pretext, crawl, scrape, or use automated means without our prior written authorization; for an obscene or immoral purpose; or to interfere with or circumvent the website’s or Services’ security features. We may terminate your use of the Services for any violation of this section.
14. Intellectual Property and Confidentiality
All Product manuals, branding, trademarks, packaging, designs, photographs, text, graphics, videos, software, website content, and other proprietary materials are owned by or licensed to SaunaBox and are protected by applicable intellectual-property laws. Except as expressly permitted in writing by SaunaBox, you may not copy, reproduce, modify, reverse engineer, distribute, publicly display, create derivative works from, or exploit proprietary materials.
15. Disclaimer of Warranties and Limitation of Liability
We do not guarantee that use of the Services will be uninterrupted, timely, secure, or error-free or that results obtained from the Services will be accurate or reliable. We may remove or cancel the Services at any time without notice.
To the fullest extent permitted by applicable law, your use of the Services and Products is at your sole risk. Except as expressly stated in the limited warranty or as required by applicable law, the Services and Products are provided “as is” and “as available,” without representations, warranties, or conditions of any kind, whether express, implied, or statutory.
To the fullest extent permitted by applicable law, SaunaBox’s total aggregate liability arising out of or relating to a Product, the Services, or these Terms will not exceed the original purchase price paid for the specific Product giving rise to the claim. In no event will the Released Parties be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost revenue, lost savings, loss of data, replacement costs, medical expenses, downtime, loss of use, or property damage, whether based in contract, tort (including negligence), strict liability, or another theory, even if advised of the possibility of those damages.
Some jurisdictions do not permit certain exclusions of warranties or limitations of liability. In those jurisdictions, the exclusions and limitations in these Terms apply only to the extent permitted by law.
16. Termination; Severability; and Entire Agreement
These Terms remain effective until terminated by you or SaunaBox. You may terminate these Terms by ceasing to use the website and Services and by notifying us that you no longer wish to use them. We may terminate or suspend your access to the Services at any time without notice if we reasonably believe that you have violated these Terms. Obligations and liabilities incurred before termination survive termination.
If any provision of these Terms is unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law and severed to the extent necessary without affecting the enforceability of the remaining provisions.
These Terms, together with policies and operating rules posted on the website or incorporated by reference, form the entire agreement between you and SaunaBox concerning the Services and supersede prior or contemporaneous agreements, communications, and proposals concerning the same subject matter. Our failure to enforce a right or provision is not a waiver. Ambiguities will not be construed against the drafting party.
17. Governing Law and Binding Arbitration
These Terms and any separate agreement under which we provide Services are governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles, except where another jurisdiction’s law must apply.
To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms, a Product, or the Services will be resolved by binding arbitration administered under the rules of the American Arbitration Association in California. The parties waive the right to a jury trial. Nothing in this section limits either party’s right to seek relief in a court of competent jurisdiction where arbitration is unavailable or prohibited by applicable law.
18. Changes to These Terms
You may review the most current version of these Terms on this page. We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms by posting the revised Terms on the website. Your continued access to or use of the website, Services, or Products after revised Terms are posted constitutes acceptance of the revised Terms, unless applicable law requires another form of notice or consent.
19. Final Acknowledgment
By purchasing, installing, owning, or using a Product, the Undersigned acknowledges that they have carefully read and understood these Terms, including the medical disclaimer, safety requirements, assumption of risk, release of liability, limitation of liability, and limited warranty policy; understand the risks and limitations described in these Terms; and agree to be bound by these Terms as a condition of purchase and use.
WARNING: Failure to follow the product manual, to review safety instructions regularly, or to operate Products as directed may result in serious injury, illness, death, property damage, and voided warranty coverage. Use Products at your own risk.
